TERMS OF USE AND PRIVACY POLICY
These TERMS OF USE govern the relationship between “EDINSTVENA” Ltd (hereinafter “EDINSTVENA”) and the users of websites and services operating on the domain https://edinstvena.bg/ (hereinafter “Users”).

By browsing https://edinstvena.bg/, each User agrees to comply with these Terms.
These Terms and Privacy Policy provide information about EDINSTVENA's operations and the conditions for using its services, and define the relationship between the company and its registered users.
Acceptance of the Terms is required to form a contract between the User and EDINSTVENA.
1. Services Provided
Article 1. EDINSTVENA provides information society services under the Electronic Commerce Act.
Article 2. EDINSTVENA operates an online store at https://edinstvena.bg/, where Users can enter into purchase and delivery contracts for goods offered.
2. Identification & Registration
Article 3.
EDINSTVENA identifies Users by storing server logs and IP addresses.
It may collect personal data (name, date of birth, gender, address, phone), as well as voluntarily provided info and usage data.
Users may also register via Facebook or Google.
Article 4.
EDINSTVENA takes due care to protect Users’ data, except in cases of force majeure, accidents, or third-party malicious acts.
The registration form indicates which fields are mandatory or optional and the consequences of not providing them.
The above protections do not apply if EDINSTVENA is legally required to share user data with competent authorities.
Article 5.
Data collected in accordance with Article 4 may be used for purposes outlined in these Terms, and to offer new goods/services. This list is not exhaustive.
By accepting these Terms, the User agrees to processing personal data for contract execution and direct marketing.
Article 6.
Users may register online, accept the Terms, and declare legal capacity.
Clicking "Register" constitutes electronic acceptance of the Terms, making it an electronic document able to be reproduced. EDINSTVENA may store logs and IP addresses associated with this consent.
Users must provide and update accurate personal data within 7 days of any change. If false data is provided, EDINSTVENA may suspend or terminate services and user accounts immediately.
Article 7.
Upon registration, Users receive a unique username and password.
The username grants no rights other than access to the online store.
A registrant for a legal entity must provide full name and address, confirming authority. Incorrect data may result in denial of access.
Users are responsible for keeping their password secure and must report unauthorized access immediately. They are liable for all activity under their account.
Article 8.
Users have the right to access services online by entering their credentials.
Users can access and correct their personal data online.
3. Placing an Order
Article 9.
Users use the site interface to conclude purchase and sale contracts. Orders can also be placed by phone.
A contract is concluded once EDINSTVENA confirms the order.
EDINSTVENA reserves the right to decline orders if goods are not in stock.
Article 10.
Users must be registered/logged in to place orders.
Users add goods to a cart ("basket").
Users must provide delivery details and select payment method, then confirm the order.
A confirmation email is sent once the order is accepted.
4. Prices
Article 11.
Product prices are as listed on the site at order time, except in obvious errors.
Prices include VAT when applicable.
Article 12.
EDINSTVENA may change prices at any time without notice; changes do not affect already placed orders.
Article 13.
Discounts may be offered in compliance with Bulgarian law and EDINSTVENA’s rules; terms are displayed where discounts are shown. Discounts may include promotions, loyalty bonuses, or event participation.
Different discounts cannot be combined on the same item.
5. Payments
Article 14.
If a product is returned under the withdrawal right, the refunded amount is reduced by any discounts applied. Only the amount actually paid will be refunded.
Article 15.
The User may pay for the ordered goods only via online card payment through the website https://edinstvena.bg.
Cash on delivery is not available. All orders must be prepaid online using the secure card payment system on the website.
Article 16.
If a third-party payment provider is used, users may be bound by that provider’s terms and fees.
Article 17.
EDINSTVENA is not responsible if a third-party payment method is unavailable through no fault of EDINSTVENA.
6. Delivery
Article 18.
Delivery is by courier within Bulgaria, typically at the customer’s expense unless otherwise stated.
EDINSTVENA may call the User before shipment to clarify details.
EDINSTVENA is not responsible for orders delayed or unfulfilled due to incorrect user data.
Prepaid orders are dispatched 3–5 days after payment. For expedited delivery, Users may inquire in advance.
Article 19.
Delivery is performed within the timeframe indicated for each option; in exceptional cases, EDINSTVENA may extend delivery time with notice.
Article 20.
Orders are delivered against a signature; large packages may be delivered to the building entrance.
Users must inspect goods upon delivery and immediately report discrepancies; if not, delivery is considered accepted.
Article 21.
If personal delivery is impossible, packages may be left with a co-resident or coworker (name recorded).
If delivery fails for reasons beyond control, the courier will contact the User.
If contact cannot be established, the distance contract is canceled.
Article 22.
For international deliveries, terms of the postal operator and destination country law apply.
All import duties are borne by the User; no price refund if duties are refused.
Article 23.
EDINSTVENA may change delivery and payment methods or terms at any time by posting updates on its site.
7. Right of Withdrawal & Returns
Article 24.
Users have a 14-day right to withdraw without reason, obligation, or penalty, counted from order receipt.
Withdrawal notice must identify the goods, order details, recipient, and delivery date.
A withdrawal form is available on the site.
The form or equivalent communication will be acknowledged on a durable medium.
Returned goods (with receipt/invoice) must be sent back within 14 days at the User’s cost.
Refunds may be delayed until goods are received or return proof is provided.
If the User fails to return as required and gives no excuse, withdrawal is considered void.
Article 25.
No withdrawal right is provided for individually customized goods, perishables, newspapers/magazines, sealed health or hygiene products after opening, or sealed audio/video/software after unsealing, and for digital content whose delivery makes withdrawal pointless.
Article 26.
Refunds are issued for returned goods. Card refunds are processed through the original card used.
8. Complaints
Article 27.
Users may lodge a complaint for non-conformity after delivery.
Complaints may be made regardless of any commercial guarantee; normal wear and tear is excluded.
If a complaint results in product replacement, original warranty remains.
Complainants may ask for a refund, replacement, or price reduction.
Complaints can be made by phone, email, mail, or form available on the website.
Complaints should specify the issue, desired resolution, claimed amount, and contact details.
Supporting documents (receipt/invoice, reports/protocols, etc.) must be included.
Complaints must be made within two months of noticing the defect or validity expiration.
Time limit is suspended pending dispute resolution.
If commercial warranty lasts longer than legal complaint period, complaint can be made until warranty expiry.
Making a complaint does not limit the right to sue.
EDINSTVENA maintains a complaint register and emails the user a case number.
Upon successful resolution, an official act is issued in two copies, one for the User.
9. Warranties
Article 28.
Users benefit from consumer protection law warranty periods.
10. Unilateral Termination
Article 29.
EDINSTVENA may unilaterally terminate the contract without notice if services are used in violation of Terms, Bulgarian law, or moral norms.
11. Intellectual Property
Article 30.
Intellectual property rights of all site materials and resources are owned by EDINSTVENA or licensors and protected by copyright law.
Unauthorized copying or reproduction may result in liability for damages.
Users may not reproduce, modify, delete, publish, distribute, or disclose content without permission.
Article 31.
EDINSTVENA shall provide stable access to services.
Accounts may be deactivated or deleted if IP rights are violated.
EDINSTVENA may suspend access after notice and may remove user-submitted materials.
12. Contract Termination
Article 32.
Contract ends if EDINSTVENA ceases activity or site operation.
On termination, the User’s account is deactivated and password removed.
Socks, leggings, swimwear, and underwear are non-returnable and non-exchangeable.
Article 33.
Outside specified cases, either party may terminate the contract with one week’s notice in case of breach.
Article 34.
Contract is considered in written form if through email, button click, checkbox, etc., as long as it is technically recordable.

14. Severability
Article 36.
If any clause is invalid, the remainder remains effective; invalid clauses are replaced by applicable law.
15. Changes to Terms
Article 37.
EDINSTVENA shall inform Users of changes within 7 days via email.
Users may withdraw within one month without penalty.
Failure to withdraw constitutes acceptance.
16. Applicable Law
Article 38.
Bulgarian law applies to any matters not regulated herein.
17. Security & Online Payments
Article 39.
Card payments are processed via BORICA AD's secure 3‑D Secure platform.
EDINSTVENA does not access or store card data.
Refunds for card payments are returned to the same card.
All transactions are in BGN, VAT included unless stated otherwise.
18. Personal Data Protection
Article 40.
EDINSTVENA processes personal data per GDPR and the Bulgarian Data Protection Act. It is the data controller.
Processed data may include name, address, phone, email, order history, IP, and payment data (excluding card numbers).
Data processing purposes: registration, order fulfillment, accounting, customer support, marketing (with consent), legal compliance.
Legal grounds: contract, legal obligation, legitimate interest, or consent.
Data may be shared with couriers, accountants, IT providers, banks, and authorities when lawful.
Data is retained for up to 5 years from last activity or until legal grounds expire.
Users have rights: access, correction, deletion (“right to be forgotten”), restriction, portability, objection, consent withdrawal, and complaint to CPDP (www.cpdp.bg).
